Russian Criminals Given Choice: Go to War or Face Court

As Russia becomes increasingly threatening, so too must its threats be contained. This weeklong battle over a high profile court case-year-old Olympic gold medallist Andrey Perlov, an ex-managing director of a Novosibirsk football club, was plunged into high-profile court battle this past week after police came to his home and accused him of embezzling a sum of about three million roubles ( roughly $32,000) to which Perlov and his family objected in the strongest terms he is being held against his will and compelled to join the fight in Ukraine.

Detention and Coercion

Perlov has been in custody for over six months, and his relatives claim that with time, he had been under more and more pressure to sign up for military service. His family claims that the officers have promised that they can freeze or even drop the case of embezzlement against him if he agrees to fight in Ukraine. Such a case illustrates an alarming practice in Russia: in the entire length of the war, law enforcers are said to be recruiting detained citizens and defendants to join the armed forces.

Legal System of Recruitment

The Russian government recently enacted new legislation that allows a person charged with various crimes the legal right to opt for military service instead of being prosecuted legally. This new law was passed in March 2024, requiring prosecution and defense lawyers to notify an accused person of this legal right. When a person enrolls in military service, their case is usually considered closed at the war’s end. According to Olga Romanova, head of the NGO Russia Behind Bars, “This has turned Russia’s law enforcement system upside down.”

The Scary Outlook

The result of this new law is more alarming. Outcomes are such that those convicted of heinous crimes can also opt for military service to sidestep legal proceedings. Investigators are caught colluding with detainees to take military contracts to sidestep legal trials. For instance, in a recently released audiotape, an investigator is heard telling a woman whose husband was convicted for theft that his case would be closed if he was willing to ‘fight’.

Tragic Consequences

Military service for some has turned out to be an easy excuse to commit a crime and go unpunished by imprisonment, but war can turn out to be very merciful. One such tragic example is the case of teenager Yaroslav Lipavsky, who was charged with severe assault. He joined the army to avoid prosecution and was killed in Ukraine within a week. This is just one such fatal case for such decisions.

Social Context and State Policy

According to analysts, the Russian government looks at them as it can afford to lose them; the government will incur little loss from society’s point of view. As military analyst Michael Koffman of the Carnegie Endowment for International Peace puts it, the government most probably perceives these detainees as people who “nobody will miss” and whose absence will not adversely impact the economy.

Recruitment Beyond Convicts

When the recruitment drive was initially initiated, it mainly targeted the convicted. The scope of the drive has since been expanded to include detainees who are awaiting trial. Classified documents have revealed that the Wagner Group recruited approximately 50,000 inmates, and these fighters incurred heavy casualties. This recruitment drive mirrors Russia’s urgent military personnel necessity but also sets it on the path toward managing its homegrown law enforcement issues.

Resistance and Pressure

Not all detainees give in to the recruitment drive despite the various pressures. Alina, Perlov’s daughter, says her father has been heavily punished for his militancy against the draft system. After issuing a press statement in local media, he was put into a rigid punishment cell and faced more pressure. Alina’s emotional account describes the situation of her family as they await fair judgment to prove him innocent before a judicial system that seems to show disinterest in people’s rights.

Conclusion

Tragic cases like Andrey Perlov form part of the evidence of this crossroads where justice becomes implicated with war within modern Russia. A conflict that surrounds a military recruitment policy in Russia today has escalated so dramatically that forcing such individuals to fight instead of facing their trial raises concerns about the severe legal and ethical repercussions that may unfold. Today, the Russian authorities still have not made one word on the case of Perlov or the supposed coercion of inmates into military service.
